Territory of India.

4) AIMS & OBJECTIVES OF INSTITUTE :-

As per the Constitution of India –
In the draft resolution passed in 1948 and in the amendments prior to 1976 ‘Morality’ was included in Article 19. Further after 1976 in Article 25 it has been comprehensively stated that the following four disciplines viz. a) Public order. b) ‘Morality’.c) Health. d) ‘Other provisions of this part’ are ‘Secular’.
Vide Article 25 (1) the Constitution itself makes ‘ freedom of conscience’ subject to a) Public order. b) ‘Morality’.c) Health. d) ‘Other provisions of this part’. All persons are equally entitled to ‘freedom of conscience.’
Keeping the above four disciplines fully under its control the secular Indian constitution also grants every citizen ‘freedom of conscience’. Naturally then, the onus of entire responsibility of ‘morality’ lies with the government.
Vide Article (51 A) FUNDAMENTAL DUTIES
It shall be the duty of every citizen of India –
(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;
Though it has been clearly stated that developing scientific temper, humanism and spirit of enquiry and reform is a fundamental duty, the knowledge of 1) Secular Ethics 2) Humanism 3) Conscience and 4) Fundamental duties are not imparted to every citizen/child through education.

The fundamental responsibility of the Government and NGO’s then is to provide education and create awareness on the above mentioned important fields to ensure a fair societal setup.

  1. To achieve the above we intend to establish ‘Academy of Secular Ethics & Humanism’ and conduct research in humanism, conscience and secular ethics (the thoughts essential to lead a normal and happy life during one’s life period i.e. period between one’s birth and death) in a scientific manner.
  2. As per Article 25 (1) of Indian Constitution for e.g. to maintain ‘Public Order’, there is an independent ministry headed by a minister and necessary provisions are made to pursue education in law even up to LLD. Similarly ‘Morality’ also being a secular concept a framework as above is unavailable. Our efforts shall be to introduce a ‘school of thought’ in this direction and present a theoretical base to create a separate Department / Ministry of Secular Ethics.
  3. To create awareness in the minds of the people on their ‘Right to Knowledge’, i.e. it is the ‘right’ of every individual to possess the ‘thoughts of knowledge’ and a ‘fundamental duty’ to behave and to bring into practice these thoughts and lead a happy life as expected by the Indian constitution.
  4. To develop curriculum on secular ethics & humanism at various educational levels.
  5. To establish training centers to train teachers on the thoughts of secular ethics and humanism on experimental basis.
  6. To establish schools to impart education in ‘secular ethics’ and humanism.
  7. To propagate the thoughts of knowledge to the general public through mass and adult education
  8. To conduct training programs in secular ethics and humanism for employees of state, central government and private organizations with prior permission of the concerned Departments.
  9. To create and develop in every citizen a ‘capability and will’ to perform the fundamental duties as stated in Article 51A (h) of Indian Constitution.
  10. To develop the competencies of the children of various age groups.
  11. To conduct research and work on behavioral development of children.
  12. To work in safeguarding the ‘Rights of Child’.
  13. To provide relief and succour to the sufferers of natural calamities, victims of social unrest and other accidental happenings by providing food, medical aid, help in legal proceedings, claims and also to undertake rehabilitation work without discrimination of religion, caste or creed.
  14. To provide educational facilities to the weaker sections of the society.
  15. .
  16. Establishment and / acquisition and maintenance or support of Schools, Playschool, Montessori’s, Colleges., Balmandirs, Study centers and other institutes for imparting education and training to the students.
  17. Establishment & Maintenance of Hostels & / or boarding houses & grant of free boarding to poor & deserving students upon such terms & for such period in each case as directors may think fit.
  18. Awarding Scholarship & fellowship on such terms & conditions as the directors may think fit for the purpose of undertaking higher education and research work.
  19. To give prizes or awards to such an individual or institute who have afforded & remarkable services in the field of education, medicine, social field, agriculture or media.
  20. To grant scholarships to the poor and needy students.
  21. To establish part-time educational centers to create awareness amongst the elders of the society to make efforts to train the off-springs in moral values and to ward off evil.
  22. To promote moral values in general public by inculcating sense of responsibility and sensibility towards individual, society and the Nation. Adopting ways and means to eradicate illiteracy/prejudices/hatred/mistrust and misunderstanding, resorting to methods helpful to creating a sense of vice and virtue, sensibility to human values, brotherhood of humanity, and anything which is desirable and good, in the interest of achieving and promotion of human values.
  23. To undertake ancillary activities helpful in attaining the objectives such as organizing distribution of published and other required literature to promote the objectives by adopting ways and means conventional or otherwise as available within the means of the institute, and if any surplus accrues on account of this activity(ies) it shall wholly be utilized for the furtherance of the objectives of the Institute.
  24. To organize seminars, symposia, workshops and the like for promoting and propagating literacy, education and other objectives.
  25. To establish and provide medical counseling, medical centers, dispensaries, diagnostic centers, hospitals, emergency medical aid centers, hearse vans, ambulances and, if required, to help and assist in different ways, financial or otherwise.
  26. To help promote better understanding amongst different sections, ethnic entities, communities, groups of different walks of life, rich and poor, and the like by organizing get-together, tea-parties, table talk, social functions and such other activities.
  27. To provide financial assistance to the poor, needy and weaker sections of our society for immediate relief in emergency in the family.
  28. To provide relief and succour to the destitute, the aged, the infirm widows and orphans and other weaker and suppressed and depressed classes of the society and for that purpose, to establish and run orphanages, homes for the destitute, handicapped etc.,
  29. Towards advancement of any other cause of general public utility.

RULES AND REGULATION OF SOCIETY


1) NAME OF INSTITUTE :- Academy of Secular Ethics & Humanism,

3) JURISDICTION OF SOCIETY :- All over India

4) DEFINITION
a) In the Rules & Regulation, unless the contest otherwise requires.

  1. Society shall mean the Academy of Secular Ethics and Humanism, Miraj, Tal- Miraj, Dist. Sangli.

  1. Executive Council means committee of persons who are at the time of institute & whom the affairs / responsibilities of the institute are confirmed or vested.

5) EXECUTIVE COUNCIL MEMBER:
Executive Council Member means a person who accepts & agrees to abide by rules & regulation of the institution by paying sum decided by the executive council.
1. Executive Council Member:
First executive council which is signed on the memorandum of association and paid Fees of Rs. 1001/- will be founder members which will be minimum 9 and maximum 15 in number.

6) MEMBERS :

  1. Person of Indian origin ( major) will be granted membership after scrutinizing his/her application in the Executive Council and after receipt of the fees prescribed from time to time by the Executive Council.
  2. The applicant shall not be granted the membership of institute unless he/she pays & undertakes to pay the regular fees as may be fixed by the executive council annually or PRESIDENT, VICE-PRESIDENT, SECRETARY otherwise of the institute & may breach there shall render the membership of such member liable to be extinguished by the executive council.








PRESIDENT SECRETARY



  1. TERMINATION OF MEMBERSHIP :
The membership of the institution may be terminated in any of the following ways;
a. By death
b. By resignation in writing & only after acceptance of the same by executive council.
c. By default in payment of subscription, annual subscription, for months even after
the receipt of notice from the institution.
d. By expulsion after notice & after inquiry on the ground that the conduct of the
member determined to the comply with the rules regulations or by law of society
provided that such member shall give an opportunity of benign heard & the
resolution of expulsion is passed by the majority in general body.

  1. GENERAL BODY :

      1. The general body shall consist of all the members of institution
      2. The general body shall be empowered to frame Rules & by-laws of the institution by notice less than 1/2th majority of total strength of the council.

  1. EXECUTIVE COUNCIL :

      1. The executive council shall be the permanent body consisting of not less than 9 & more than 15 members.
      2. Vacation of the seat of executive council shall be filled up immediately, by co-opting any person from the member of the institute the executive council by simple majority.
      3. The executive council shall be empowered to frame the rural & regulations for the conduct of the business of the institute.
      4. The President, Vice-President, Secretary & Jt. Secretary will be elected by the executive council.

  1. OFFICE BEARS :

A) President :
1. President shall be chief executive head of the institute.
2. Member of council shall be eligible to elect as a president.
3. The president shall be Ex-officer chairman of the institute.
4. The president shall have a casting vote in the business institute.
5. The executive shall elect any person from the executive council as president.
6. The president shall be empowered with prior approval of the executive council
to constitute, appoint, nominate, committee/s, commission/or realizing & achieving object of the institute.

B) Vice-President
    1. The Vice-president shall be elected by the executive council from the members of the executive council.
2. The Vice-president shall assist the president and shall discharge the duties and
exercise the power of the president in his absence.




PRESIDENT SECRETARY
C) Secretary or Jt. Secretary
1. The secretary shall be elected by the executive council from the member of the
executive council.
  1. The secretary shall plan, perform and mange secretarial affairs of the institute.
He shall be the appointing authority in respect of the staff of the secretariat with prior approval of the executive council.
3. The secretary serve as a secretary to the general body and keep a record of all
proceeding and events.
4. The secretary serve as a secretary to the general body and papers on behalf of
the Academy of Secular Ethics & Humanism, Miraj,
5. Secretary is the Directors of the Institute.
6. The secretary may appoint and discharge power of with the prior approval of the
objective council to any person.
7. The secretary may appoint and discharge power of the prior approval of the executive of the institute.

  1. DUTIES AND POWERS OF THE EXECUTIVE COUNCIL :
1. Executive council shall be the main administration body of the institute.
2. Executive council shall supervise the conduct of the academic polices of the
institute.
    1. Executive council shall consider the annual budget for final approval.
    2. Executive council shall responsible to keep account of the institute.
    3. Executive council shall exercise power to select member of the committees and
assign work to the committees.
    1. Executive council shall consider any decision of the committees.
    2. Executive council shall consider any disciplinary action against staff & faculty
member.
    1. Executive council can demand reports, returns & other information from the faculty
& instructive staff.
9. Executive council shall meet at least four times in the year on the date to the fixed
by the secretary in consultation with president.
10. Executive council shall manage & regulation properties & business of the institute.
  1. Executive council shall accept donations behalf of the institute.
12. To accept grants or aid from the government, municipalities district boards or other corporate bodies, foundations or individuals & enter in rate bodies, association & individuals.
13. To accept gifts and endorsement on such terms as the institute consider reasonable.
  1. To undertake and execute any trust, which the firm institute deems conductive to
is object and interest.
15. To borrow or raise, money, by he issue of or upon bond debenture bill if exchange, promissory notes or other obligation securities of the institution or may mortgage or charge or hypothecation of all or a by part of the property , movable or immovable or rights of the inchoate shall thick fit and to pay including brokerage, commission all other costs and charges.
16. To collect donations and subscriptions for the institute.
17. To arrange for he promotion, management and conduct of the business an object of the institute and for that purpose, to appoint office or officers, workers of workers and other em – employees an to fix and pay their honorarium, salaries remuneration or emolument.



PRESIDENT SECRETARY

          1. To pay out of the funds of the institute all costs, charges and expense of an incidental of the formation and registration of the institute and promotion, management and conduct on the business and objects of the institute.
  1. Establish, endow, contribute organize and mange, provident or benevolent found for the benefit or assistance of the staff employed by the institution and their families and dependents.
  2. To make rules, regulation an bye laws in connection with the management the institute that may be established or taken over institute that may be established or taken by the institute and to alter, modify & rescind the same.
  3. To become a member of any national or international organization to get itself affiliate with the same.
  4. To co operative with Government of MAHARASHTRA and Government of INDIA to have advice, guidance as well as financial aid from the Government of MAHARASHTRA and Government of INDIA.
  5. To do all such other acts an things as may be lawful, or conductive the attainment of the objects of the institute, Government of INDIA.

  1. ELECTION OF THE EXECUTIVE COUNCIL
Duration of the executive council will be five (5) years. After the financial years annual general meeting will be held and in that meeting election of the executive council will be majority vote.

  1. PRODUCER AND ELECTION
Any member who completed at lest one year and paid he due / arrears up to date will be entitled to contest election for executive council. If voting is required it will be through secret ballot vote. Members of the executive council will be elected after every 5 ( five ) years. Out going President & Secretary are eligible for reelection for the same post.

  1. TO FILL UP VACANCY OF EXECUTIVE COUNCIL :
Any vacancy in the executive council shall be filled by the executive council for the remaining period by majority.

16. MEETINGS :
a) GENERAL BODY MEETING :
General body meeting shall consist of all types of members and shall beheld once in every year with the 60 days the closing of the financial year on the date and place fixed by the executive council.
  1. EXECUTIVE ORDINARY MEETING :
Executive Council Meeting, if requiring any be call for any specific purpose

  1. EXTRA ORDINARY MEETING :
Extra ordinary meeting, if required any be call for any specific purpose by the president.

  1. SPECIAL GENERAL MEETING :
Special general meeting shall be called by the president within a month at any time by equitation in writing signed by not less than 2/3 members of the general body.



PRESIDENT SECRETARY

  1. QUORUM OF THE MEETING :
The quorum for Annual General Body/Special General Meeting shall be ¼ the of the total members, and for extraordinary shall no be less than 5 members. Any of the meeting nor having the request quorum within half an hour of the time fixed for the meeting shall adjourned. The adjourned meeting will proceed after 30 minutes.

  1. NOTICE OF THE MEETING :
Notice of the meeting of executive council, extra ordinary meeting and special committee Meeting and Annual General Meeting shall be given at last 10 days be fore he date of the meeting in such manner as the managing committee shall specify the time and the place were such meeting shall be held. Non receipt of notice by any member will not invalidate the processing of any meeting if the regular notice has been issue.

19) FUND & INCOME OF THE INSTITUTE :
The income & property of the institute, whatsoever derived shall be applied solely that promotion of the objects of the association and no portion thereof shall be paid transferred directly, by way of dividends, bonus or otherwise by the way of the profits to the persons

20. BUDGETED EXPENSES AND THERE PROVISION :
The estimated percentages of expenses are as follows,:
Object No. 1 To 15 : 50%
Object No. 16 To 30 : 50%
The general body has a special power to change the above mentioned ratio of
expenditure, whenever it seems to be essential.

21. ACCOUNT
The following will be the source of funds of the institute. Membership & Entrance fees, Donations & Government Grants & income from publication charity shows etc. all these received funds shall be deposited in the bank or bank approved by the executive council in the name of institute & Secretary.

22. LIST OF MEMBERS
A list of members will be maintained updated according to the provision or rule of 15 of 1971 under Registration of Societies Act. ( MAHARASHTRA ) 1971 in the form of schedule to the rules in respect of such meaning of section 15 of the societies registration Act, 1860.

  1. DISPOSAL & PURCHASE OF PROPERTY:
Society can purchase and dispose of its own property or assets, if require, but before the disposal of property society shall nave fulfill he legal formalities under Bombay Public Registration Act. 1950 with Rule 36 take permission of Joint Charity commissioner, Pune.

24. CHANGE IN THE RULES & REGULATIONS:
The generated body may from time to time pass bye laws which are not inconsistent with the present objectives of the institute by simple majority.
25. CHANGE IN THE NAME & OBJECTIVE:
Change in the name & objectives of the institute and amalgamation with any other association, action will be taken as per section 12. 12(A ) of the societies Registration Act., 1860.

26. WINDING UP OF THE INSTITUTION :
If the institution is to be dissolved the provision of section 13 & 14 of the Societies Registration Act, 1860 and Bombay Public Trust Act.1950 will be followed, The institution shall be disposed of in accordance with decision of the dissolving meeting.
